Terms of Service
Effective October 1, 2026 · Version 2026-10-01
These Terms of Service (“Terms”) govern your access to and use of LiveSceneMix, including the LiveSceneMix website, applications, services, features, and related content (collectively, the “Service”).
The Service is operated by [LEGAL ENTITY NAME], doing business as LiveSceneMix (“LiveSceneMix,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines.
1. Eligibility
By creating an account or using LiveSceneMix, you represent that you are at least 18 years old, are legally capable of entering into these Terms, and that the information you provide is accurate.
We may suspend or terminate accounts that do not meet these requirements.
2. Your Account
You agree to provide accurate information and to keep appropriate account information current.
You may not impersonate another person, performer, project, venue, business, or organization; create an account using another person’s identity without authorization; access another user’s account without permission; sell or transfer an account in a manner that compromises security; or use deceptive or automated methods to create accounts.
You should notify LiveSceneMix promptly if you believe your account has been accessed or compromised without authorization.
3. LiveSceneMix Is a Platform
Unless expressly stated otherwise, LiveSceneMix is not an employer, talent agency, booking agent, performer manager, venue representative, or party to agreements entered into between users.
LiveSceneMix does not independently verify the identity, background, professional qualifications, musical ability, availability, reliability, safety, or representations of every user.
You are responsible for evaluating other users and deciding whether to communicate, audition, rehearse, perform, meet, book, hire, or enter into any agreement with them.
4. User Content
User Content may include profile information, biographies, photographs, videos, audio, links, project information, repertoire information, songs, set lists, events, venue information, messages, notes, and other materials.
You retain ownership of User Content that you own.
By providing User Content to LiveSceneMix, you grant LiveSceneMix a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and distribute that content only as reasonably necessary to operate, provide, secure, maintain, improve, and promote the Service in a manner consistent with the visibility and sharing features you use.
This license ends when the applicable User Content is deleted from our active systems, except where continued retention is reasonably necessary for backups, security, fraud prevention, legal obligations, dispute resolution, or enforcement of these Terms.
You represent and warrant that you have all rights, licenses, permissions, and authority necessary to submit User Content and allow LiveSceneMix to use it as described in these Terms.
5. Responsibility for User Content
You may not submit, upload, transmit, publish, or distribute content that is unlawful; infringes copyright, trademark, privacy, publicity, or other rights; contains pornography or sexually explicit material; contains nonconsensual intimate imagery; sexually exploits, depicts, or endangers minors; threatens or encourages violence or unlawful harm; harasses, stalks, intimidates, bullies, or abuses another person; promotes hatred or violence against people based on protected characteristics; impersonates or deceptively misrepresents another person or organization; discloses another person’s private information without authorization; contains malware, malicious code, or harmful software; promotes scams, fraud, or deceptive activity; constitutes spam or repeated unwanted solicitation; facilitates unlawful activity; or otherwise violates these Terms or the Community Guidelines.
LiveSceneMix may remove, restrict, disable, or limit access to User Content that violates these rules or applicable law.
6. Messaging and Communications
You may not use LiveSceneMix communications to harass or threaten another person; repeatedly contact someone after they have asked you to stop; send sexually explicit or unwanted sexual content; send fraudulent solicitations or scams; distribute spam; impersonate another person; distribute malware or malicious links; or otherwise violate these Terms or the Community Guidelines.
LiveSceneMix does not guarantee that communications sent by users are accurate, authentic, appropriate, or safe.
You should use reasonable judgment before sharing personal information or meeting another user in person.
7. Projects and Collaboration
A user may participate in multiple projects.
Project owners and authorized administrators may manage project information, membership, invitations, songs, repertoire, set lists, calendars, messages, events, and other project-related content according to the features made available by LiveSceneMix.
Project information may be visible to other members of the applicable project.
You should not place information into shared project areas that you do not want other authorized project members to see.
LiveSceneMix may restrict, archive, suspend, or remove projects that violate these Terms or applicable law.
8. Saved Musicians and Private Notes
These features are intended for legitimate personal or professional organization.
Users may not use private-note functionality to maintain unlawful, threatening, discriminatory, exploitative, or otherwise abusive material.
A feature labeled “private” is designed not to be shown to the subject of the note or to ordinary users who are not authorized to view it. “Private” does not mean the information is immune from access by authorized LiveSceneMix personnel when reasonably necessary for security, support, abuse investigations, legal compliance, backups, or other purposes described in the Privacy Policy.
9. Events and Venues
Users are responsible for ensuring that information they provide is accurate and that they have authority to publish it.
LiveSceneMix does not guarantee that any event will occur; that a venue will honor a booking; that a performer will appear; that event information will remain accurate; or that users will fulfill agreements made with one another.
10. Prohibited Conduct
11. Reporting Content and Users
LiveSceneMix may investigate reports and may take actions including removing content, limiting content visibility, restricting functionality, warning users, suspending accounts, terminating accounts, preserving information, or referring matters to appropriate authorities where reasonably necessary.
Submitting a report does not guarantee a particular outcome.
Knowingly submitting false, deceptive, harassing, or abusive reports may itself violate these Terms.
12. Nonconsensual Intimate Imagery
LiveSceneMix provides a process for reporting such material.
Where required by applicable law, LiveSceneMix will process valid removal requests within legally required timeframes and take additional steps required by law concerning covered copies of reported material.
If you believe intimate content involving you has been shared without your consent, use the LiveSceneMix reporting process and select the category for nonconsensual intimate images or video.
13. Copyright and DMCA
LiveSceneMix respects intellectual property rights and may remove or restrict content alleged to infringe copyright.
Copyright owners or their authorized representatives may submit notices to LiveSceneMix’s designated copyright contact:
DMCA Agent or Position: [DMCA AGENT OR POSITION] Email: info@livescenemix.com Mailing Address: [DMCA MAILING ADDRESS] Telephone: [DMCA PHONE]
Copyright notices should contain the information required by applicable law.
LiveSceneMix maintains a policy of terminating, in appropriate circumstances, users who are repeat copyright infringers.
Where applicable, LiveSceneMix may provide a process for submitting counter-notifications.
Nothing in these Terms represents that LiveSceneMix has completed any government registration that has not actually been completed.
14. Moderation
Except where required by law, LiveSceneMix is not obligated to proactively monitor every item of User Content or every communication.
No moderation system is perfect. LiveSceneMix does not guarantee that all prohibited or objectionable material will be detected, reviewed, or removed immediately.
15. LiveSceneMix Intellectual Property
These Terms do not transfer ownership of LiveSceneMix intellectual property to users.
You may not reproduce, modify, distribute, reverse engineer, or commercially exploit LiveSceneMix software, branding, or proprietary materials except as authorized by LiveSceneMix or applicable law.
16. Feedback
Nothing in these Terms prohibits you from providing an honest review, assessment, or opinion regarding LiveSceneMix.
17. Third-Party Services
LiveSceneMix is not responsible for third-party content, availability, security, terms, policies, or privacy practices.
Your use of third-party services may be governed by separate agreements with those providers.
18. Suspension and Termination
LiveSceneMix may suspend, restrict, or terminate an account when we reasonably believe that a user violated these Terms or applicable law; presents a security or safety risk; has used the Service unlawfully; threatens users, LiveSceneMix, or the integrity of the Service; has attempted to evade enforcement action; or when suspension or termination is otherwise reasonably necessary to operate or protect the Service.
Where appropriate, LiveSceneMix may provide notice or an opportunity to appeal. Immediate action may be taken where reasonably necessary for safety, security, legal compliance, or prevention of harm.
19. Service Availability and Changes
We do not guarantee that the Service or any particular feature will always remain available, uninterrupted, secure, or error-free.
Some features may be experimental, incomplete, or changed over time.
20. Disclaimer of Warranties
LIVESCENEMIX DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
LIVESCENEMIX DOES NOT WARRANT OR GUARANTEE THE IDENTITY, CONDUCT, SAFETY, RELIABILITY, AVAILABILITY, PROFESSIONAL ABILITY, MUSICAL SKILL, SUITABILITY, OR REPRESENTATIONS OF USERS, PERFORMERS, GROUPS, VENUES, OR OTHER THIRD PARTIES.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LIVESCENEMIX FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
(A) ONE HUNDRED U.S. DOLLARS ($100); OR
(B) THE AMOUNT YOU PAID DIRECTLY TO LIVESCENEMIX DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit certain limitations of liability, so these limitations apply only to the extent permitted by law.
22. Indemnification
23. Governing Law and Venue
Unless applicable law requires another venue, disputes relating to these Terms or the Service will be brought in a court of competent jurisdiction located in the State of New York.
Nothing in this section prevents either party from seeking relief in another jurisdiction where applicable law requires or permits it.
24. Changes to These Terms
When changes are material, we will provide reasonable notice through the Service or another appropriate method.
Where required or appropriate, we may require users to affirmatively accept an updated version before continuing to use some or all of the Service.
